Well, I was not the client of this firm, but the buyer of my house was. The buyer who hired the lawyer of this firm is feeling frustrated as her lawyer missed payment to my lawyer on possession date yesterday. The reason: They told the buyer, they didn’t receive documents from my lawyer who actually has sent documents to them by fax days ago. I think they were expecting to receive these documents by email? Professionalism is an issue. They knew the possession date, but knowingly ignored it without tracking with seller's lawyer on or before possession date. This was what I found on Google: In Saskatchewan, a lawyer can be held responsible if they fail to meet trust conditions or undertakings that lead to a delay in possession day. If the seller's lawyer doesn't provide necessary documents, and this causes a delay, the buyer's lawyer could be liable if they had a specific responsibility to ensure those documents were provided or if they breached a trust condition. Missing Documents and Possession Delay: If the seller's lawyer fails to provide necessary documents, such as a survey or title documents, and the buyer's lawyer has undertaken to ensure these documents are provided or if the lawyer was responsible for coordinating the closing, they may be liable for the delay in possession.
Example:
If the seller's lawyer was supposed to provide a certificate of possession and a survey showing no encroachments, and they failed to do so by the possession date, the buyer's lawyer could be held responsible if they had an obligation to ensure these documents were provided.
